Conditions of the Villa Garden and Sea Vacation Rental Agreement
1. The Villa reservation is made by paying a €300 deposit. The reservation deposit must be paid by bank transfer or PayPal. The deposit will be returned by bank transfer or PayPal upon termination of the contract, once the keys to the villa have been returned and the villa is in perfect condition as it was delivered. Your reservation will not be confirmed until the prepayment of the rental deposit has been received and you have received a confirmation email. The remaining amount must be paid in cash upon check-in on the day of your arrival.
2. At the end of the above-mentioned rental period, the property must be returned in the same condition as it was received on the first day, with all household items, furniture, and other furnishings collected and cleaned. In the event of breakage of household goods, furniture, or other equipment, the costs of replacement or repair will be borne by the tenant, provided that the damage is accidental and not due to normal wear and tear.
3. The villa complies with all applicable legislation on tourist or vacation rentals and is duly registered in the tourist accommodation census of the Valencia Tourism Department. It is delivered fully equipped and available for immediate occupancy.
4. No one other than the reservation holder (along with those indicated in the reservation) may stay in the villa. If the reservation holder is not the reservation holder, they must have sent authorization from the person they designate to sign the contract on their behalf as the reservation holder.
5. It is strictly prohibited to accommodate more people than indicated in the confirmed reservation. Minors are also not permitted to stay here without their parents or, where applicable, legal guardians. Legal guardians are required to present express parental permission through a certified document issued by official institutions (Police, Consulate, or Embassy) in their countries of origin.
Clauses
First. - The tenant's address is the one shown on the reservation form. Therefore, the tenant declares that she is renting the apartment for vacation, tourism, or professional travel. Under no circumstances or circumstances may the apartment covered by this contract be used as her primary residence.
Second. - The tenant declares that she is aware of the characteristics and state of repair of the property and expressly accepts them. She undertakes to maintain it in perfect condition for the duration freely agreed upon by both parties.
Third. - The tenant agrees to maintain the apartment, furnished, equipped, and equipped with all necessary facilities and supplies. Any damage or loss that may occur, whether caused by the tenant or by persons living, visiting, or staying in the apartment, will be their responsibility.
Fourth. - The tenant assumes direct and exclusive responsibility and releases the property from all liability for any damage that may be caused to persons or property and is not derived from installations for services and supplies.
Fifth. - It is considered an essential condition that the home be occupied and enjoyed without causing noise or disturbance to the neighbors. Any justified complaints from the neighbors will be considered grounds for immediate termination of the rental, with the loss of any amounts paid as a deposit as compensation and non-refund of the rent paid.
Sixth. - Upon expiration of the agreed term, the tenant must leave the villa covered by this contract vacant and empty, except for the furnishings.
Apartment Reservation
The villa reservation is made by paying the rental deposit for the villa.
The reservation deposit must be paid by bank transfer or PayPal.
Your reservation will not be confirmed until the prepayment of the rental deposit has been received and you have received a confirmation email.
The remaining amount must be paid on the day of arrival at check-in, in cash.
Rental Cancellation
All cancellations or changes must be made in writing via email or WhatsApp.
Cancellations and costs:
Cancellations with 7 or more days' notice: €50 of the deposit (administration fee).
Cancellations with less than 7 days' notice: the full deposit (€300).
If Villa Garden and Sea is forced to cancel the reservation due to force majeure, the client will be refunded the entire deposit. Villa Garden and Sea will not be responsible for future claims by the client.
Check-in/Check-out
Entry to the Villa begins at 3:00 PM, or as previously agreed.
Check-outs must be made before 11:00 a.m., or as agreed upon during late check-out.
On the day of departure, you must leave your apartment tidy and dispose of all trash in the nearest bins. Please leave both sets of keys on the dining table. Turn off all electrical appliances and air conditioning, leaving only the refrigerator on.
Responsibilities
The villa owner will not be liable for any direct or indirect damage that may occur as a result of the guest's use of the villa, including, but not limited to, damage, insurance, loss due to fire, theft, or criminal misconduct.
In the event of any breach of the aforementioned obligations, the villa owner will have the right to ask the guest to leave the villa, and the guest will not be entitled to any compensation.
